In Texas, child custody is called conservatorship. In a conservatorship, there are several different roles that parents can fill. These include the primary conservator, managing conservator, and possessing conservator. These roles are assigned based on the best interests of the child or children involved in the case.
The primary conservator in Texas is the parent who decides the child’s primary residence and who typically receives child support. This parent is the child’s physical custodian.
The managing conservator makes all of the major legal decisions for the child, including giving any medical consent for treatment. Parents may share the role of managing conservators, this is referred to as joint legal custody. In rare cases, one parent may hold legal decision-making power alone. In such situations, this parent is the sole legal custodian.
The possessory conservator is the parent who has visitation with the child according to a court-ordered visitation schedule. This parent generally pays child support to the other parent.

Accolades & Distinctions
Texas presumes children benefit from having both parents actively involved in their lives. Therefore, in most cases, the court typically awards parents joint managing conservators of their children. This is also known as joint custody.
When most people refer to sole custody, they are actually talking about where the child lives most of the time. However, this is known as primary conservatorship, not sole custody in Texas. Sole custody generally means that a parent has both primary conservator status and is the managing conservator, meaning that they are the only person with the legal right to make decisions for the child. In Texas, it is very rare for parents to be awarded sole custody.
Even in cases involving sole custody, however, the other parent may be granted rights to visitation time.
Parents are not the only relatives with child custody interests. Often, grandparents have child custody concerns and desire to obtain custody rights. There are cases where this is an appropriate action and in the best interests of the children in question.

Client Reviews
I had a great experience working with Jimmy Evans on my divorce case. He provided excellent counsel and always focused on getting me the best results. He was accommodating and made sure I understood each step of the process. His paralegal, Dina, was also wonderful! She kept communication clear and timely, and I could always count on her for quick updates and answers. The firm as a whole was efficient, professional, and supportive, which made a difficult process much easier to navigate. I highly recommend Jimmy Evans and his team.
